INTRODUCTION
This Privacy Policy applies to Servco Australia Pty Ltd ACN 123 482 717 and its subsidiaries (including Servco Australia Automotive Pty Ltd ACN 127 808 511 and its subsidiaries, and Servco Australia Motorama Holdings Pty Ltd ACN 672 085 951 and its subsidiaries) other than MB Superstore Pty Ltd trading as Finance Beagle ABN 36 010 604 350 (Finance Beagle) and the subsidiaries that operate motor vehicle dealerships (referred to as “Servco”, “we”, our). The Finance Beagle privacy policy is available on the Finance Beagle website at www.financebeagle.com.au. Each dealer makes their privacy policy available on that dealer’s website.
Servco is committed to protecting the privacy of our customers, employees, and partners, and to complying with the Australian Privacy Principles under the Privacy Act 1988 (Cth) (Privacy Act) and other applicable laws.
We will update this policy on our website (www.servco.com) if we change the way we handle personal information. Copies of this Policy will be made available free of charge to any person who requests it.
Acceptance of Privacy Policy
By engaging or dealing with us in any way, including visiting any of our physical locations, our website or contacting us by phone or email, you agree to the terms of this policy and consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy.
WHAT IS PERSONAL INFORMATION?
Personal information is defined in the Privacy Act as information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.
Personal information can include sensitive information. Sensitive information is defined in the Privacy Act as information or an opinion about a person’s race, ethnic origin, political opinions, membership of political associations and trade associations, religious or philosophical beliefs, sexual orientation or practices, criminal record, health information, genetic information about an individual that is not otherwise health information, biometric information that is used for the purpose of automated biometric verification or biometric identification and biometric templates.
WHAT KINDS OF PERSONAL INFORMATION ARE COLLECTED AND HELD BY SERVCO?
Examples of the kinds of personal information that may be collected by Servco include:
- name and contact details, such as email address, postal address and telephone number;
- identity information, including driver’s licence number, expiry date, and other identity verification data;
- vehicle registration numbers;
- vehicle enquiries, test drives, sales activity and contracts, service history and vehicle data;
- details of any roadside assistance or extended warranties purchased;
- date of birth and demographic information;
- recordings of your interactions with us including call recordings, emails and website interactions;
- CCTV footage if you visit our premises;
- communication preferences (e.g. consent to SMS, email or call);
- information about your activity on our website;
- information about the IP address and device that you use to access our website; and
- information provided as part of an application for employment including education, experience and references.
How does Servco collect and hold personal information?
Servco collects personal information from:
- individuals directly, for example when you communicate with us through our website or email or telephone our staff;
- Finance Beagle and our subsidiaries that operate motor vehicle dealerships;
- our suppliers, contractors and related entities;
- referees that you may provide in support of an application for employment; and
- from public records and other publicly accessible sources.
Upon request, we will provide you with the source of your personal information, unless it is impracticable or unreasonable to do so.
Cookies
Servco may use “cookies”, traffic measurement software or similar technologies to collect data. Most cookies will only collect de-identified personal information. However, some cookies do collect personal information.
Cookies used on our website can collect the following information from users:
- IP address;
- device type and browser;
- pages viewed and time spent;
- click behaviour;
- referring websites; and
- location approximated from your IP address.
We use this information to:
- improve website functionality and user experience;
- analyse performance and diagnose technical issues;
- understand customer interests and website traffic patterns;
- provide relevant marketing and advertising; and
- support online enquiries, test drive bookings and digital forms.
If you do not want information to be collected through the use of cookies or traffic measurement software, your device and/or browser may enable you to delete or “turn off” cookies or some the measurement software features. However, some or all parts of our website may not function correctly if such features are disabled.
The purposes for which Servco collects, holds, uses and discloses personal information
Servco may collect, hold, use and disclose personal information for the following purposes:
- to operate websites;
- to verify identity and licence status for test drives and vehicle loans, and to manage any associated fines or tolls;
- to deliver automotive products and services and to conduct other business activities;
- to arrange roadside assistance services and/or purchase extended warranties on your behalf;
- to arrange for third party products and services to be supplied to you;
- to transfer ownership of vehicles;
- to provide you with information about products or services offered by us or our related entities;
- to respond to your requests and inquiries;
- to contact individuals, via email, regular mail, telephone or otherwise;
- to provide you with information that we believe may be of interest to you or that you have requested;
- to manage warranties, recalls, services and repairs;
- to conduct customer satisfaction surveys;
- to support marketing and communications (including SMS campaigns);
- to develop and improve products, services and content;
- to protect rights and property;
- for security and occupational health and safety purposes;
- if you have applied for a job with us, to assess your suitability for the role, including verification of your identity, qualifications, certifications and entitlement to work, and we may also conduct background or criminal history checks;
- to investigate or report suspected unlawful activity;
- to protect someone’s life, health, safety or welfare; and
- to comply with a law or regulation, or a court order or other legal process.
Servco never uses any sensitive information for direct marketing purposes.
DISCLOSURE OF PERSONAL INFORMATION TO OTHER PARTIES
Servco may disclose personal information to other individuals and organisations, such as:
- our related entities and bodies corporate forming part of the Servco Pacific Inc. corporate group including Finance Beagle and our subsidiaries that operate motor vehicle dealerships;
- our service providers, contractors and suppliers;
- other third party suppliers who we arrange to provide products and/or services to you;
- valuers;
- vehicle registries;
- the manufacturer of a vehicle that one of our dealers sells to you;
- our professional advisers (e.g. lawyers and accountants);
- debt collection agencies;
- law enforcement officers, regulators, courts and government agencies, if permitted or required:
- by law, regulation, court order or other legal process;
- to assist in the prevention or detection of crime, or where a test drive vehicle or loan vehicle is involved in any parking or traffic infringements or is damaged while in your possession;
- to prevent a threat to any person’s life, health or safety; and
- any purchaser or prospective purchaser of or investor in our business, including in the case of bankruptcy, a merger, acquisition, reorganisation, sale of assets or shares, or due diligence in respect of any such transactions.
We do not disclose any of your personal information to any credit reporting bodies and do not request any information about you from credit reporting bodies.
DISCLSOURE OUTSIDE OF AUSTRALIA
Our servers are hosted in Australia, the United States of America, Singapore and Japan.
Additionally, we are likely to disclose personal information to our related entities and bodies corporate in the United States of America and Hong Kong, and to our contractors in the Philippines. We take reasonable steps to protect personal information that is disclosed overseas including through vendor diligence and imposing contractual obligations.
We may also need to send your information overseas to process transactions you have instructed us to make, such as international money transfers. The countries to which we disclose your information will depend on the transaction details.
You consent to any disclosure of your personal information outside of Australia on the understanding that if the overseas recipient handles the personal information in breach of the Australian Privacy Principles, the entity will not be accountable under the Privacy Act, and you will not be able to seek redress under the Privacy Act. The overseas recipient may not be subject to privacy obligations or any principles similar to the Australian Privacy Principles. Individuals may not be able to seek redress in some overseas jurisdictions, and overseas recipients may be subject to a foreign law that could compel the disclosure of personal information to a third party, such as an overseas authority.
Government related identifiers
Servco does not use any government related identifiers, such as passport number or driver’s licence number, as its own identifier of any individual. Servco will not use or disclose any government related identifiers other than in accordance with the Privacy Act.
Data integrity and security
Servco takes reasonable steps to ensure that the personal information that it collects, uses and discloses is accurate, up-to-date and complete. We encourage individuals to assist us with this by contacting us if you are aware that any of your personal information is not accurate, up-to-date or complete.
Servco takes reasonable steps to protect personal information it holds from misuse, interference and loss, as well as unauthorised access, modification or disclosure.
When Servco no longer requires personal information for any purpose for which the information may be lawfully used or disclosed under the Australian Privacy Principles, we take reasonable steps to destroy the information or ensure that it is de-identified, except if the information is part of a Commonwealth record or Servco is required by law or a court or tribunal order to retain the personal information.
Sensitive information
If you provide us with sensitive information about other individuals, such as sexual orientation or health information, please ensure that the individual or the individual’s representative is aware of the disclosure and that he or she consents to the disclosure to Servco as well as to the handling of their personal information in accordance with this Policy. Otherwise you must not provide us with any sensitive information about other individuals.
De-identified data
You consent to us using and disclosing your de-identified data (information that no longer identifies you) for any purpose, including, without limitation, statistical analysis, product or service development, marketing and business planning or any other commercial purpose. We undertake technical measures to ensure that this data cannot be associated back to you.
Automated decision-making systems
In limited circumstances, we may process your personal information using semi- or fully- automated decision-making systems, being any computer program or artificial intelligence, to make, or do something that is substantially and directly related to making a decision that could significantly affect the rights or interests of an individual. e.g. using a copy of your driver’s licence to upload into ID confirmation or verification software to affirm your identity.
Opting out of direct marketing communications
To opt out of receiving direct marketing communications from us, or to request that we do not disclose any of your personal information for the purpose of facilitating direct marketing by other organisations, please notify our Privacy Officer in writing and we will remove you from our marketing database. Access and correction
Individuals have a right to request access to their personal information and to request its correction. To do so, please contact our Privacy Officer. Contact details are provided below.
Servco does not impose a charge for making a request for access. However, we may charge for reasonable administrative costs incurred in providing access.
Servco encourages individuals to advise our Privacy Officer if your personal information requires correction or updating. Servco does not impose any charge with respect to requests for correction or updates.
Before correcting or providing access to personal information in response to a request, Servco will require your identity to be confirmed.
Requests for access or correction may be refused upon the grounds contained in the Privacy Act. If we refuse to provide access, or to correct personal information, Servco will provide you with reasons for the refusal.
Minors and Children’s Privacy
Servco does not and does not intend to transact with individuals under the age of 18. Individuals under the age of 18 must only communicate and transact with us with the involvement of a parent or legal guardian. Individuals under the age of 18 must not submit any personal information. Anyone providing any personal information to us must declare they are over the age of 18.
Complaints and requests for information
A person who wishes to complain about a breach of the Australian Privacy Principles by Servco should contact our Privacy Officer. General requests for information from individuals or government agencies can be directed to our Privacy Officer.
Servco will not impose any charge for making or dealing with a complaint, or for providing the information requested. Complaints and requests for information will be acknowledged by our Privacy Officer.
We will use our best endeavours to ensure that complaints and requests for information are actioned within 30 days from our receipt of the request. We will contact you if we need more time.
